1.In the absence of adequate basement impact assessment, the Council is unable to conclude that the construction can be satisfactorily carried out contrary policy D10 of the London Plan.
2.The applicant has not demonstrated the impact of the air conditioning unit, the operation of the lift and construction method method statement would have on the amenity of neighbouring dwellings. Therefore, in the absence of adequate noise report and construction method statement, officers are unable to asses the impact on the proposal on the amenities of the occupants at Nos 44 and 48 Nelmes Way contrary to policies D10 of the London Plan and 7 to the Havering Local plan.
3.In the absence of a detailed arboricultural report, showing how the construction can be achieved without causing damage to trees, would have a detrimental impact on the existing mature horse chestnut tree and the verdant character of Emerson Park contrary to policies 26 and 27 of the Havering Local Plan and the Emerson Park Policy Area SPD.
4.Statement Required by Article 35 (2) of the Town and Country Planning (Development Management Procedure) (England) Order 2015: Consideration was given to seeking amendments, but given conflict with adopted planning policy, notification of intended refusal and the reason(s) for it was given to the agent Mark Breden via email on 22/12/2022.
