| 1. | The site is within the Metropolitan Green Belt and the proposed development would not align with any of the relevant exceptions set out in Section 13 of the NPPF and would therefore comprise of inappropriate development. The proposals would make provision for a new building which would encroach into an undeveloped and open area which would not represent infill development and if permitted would set a harmful precedent. In the absence of any Very Special Circumstances which would outweigh the harm of inappropriateness and harm to openness the proposed development is unacceptable in principle and in contrast to the objectives of the NPPF including the purposes of including land within the Green Belt and Policy G2 of the London Plan 2021. |
| 2. | The formation of a dwelling in this location of the scale, bulk, mass and design concept progressed coupled with loss of the open space and dense tree cover next to the listed building and in views from the village green would be detrimental to the character and appearance of the Conservation Area and to the setting of the nearby Listed Building. The proposed development would conflict with Havering Local Plan 2016-2031 Policy 26 which requires amongst other considerations that development respect and complement the distinctive qualities, identity and character of a site. In addition the proposed development would fail to comply with S66(1) and 72(10 of the Planning (Listed Buildings and Conservation Areas) Act 1990 by failing to preserve the setting of the Listed Building and character and appearance of the Conservation Area. The level of harm would result in conflict with the NPPF and as a result Havering Local Plan 2016-2031 which at Policy 28 which refers to tests set out within the Framework. |
| 3. | The proposal, if granted planning permission on appeal, would be liable for the Mayor of London and Havering Community Infrastructure Levy (CIL). Based upon the information supplied with the application, the Mayoral CIL payable would be £4,850 based on the calculation of £25.00 per square metre and the Havering Community Infrastructure Levy (HCIL) would be a charge of £24,250 based on calculation of £125 per square metre. Each would be subject to indexation.
