| 1. | The use of the 35 Charlotte Gardens shall be as a Large House in Multiple Occupation (HMO) as defined in the Housing Act (2004), and by Use Class 'Sui Generis' of the Town and Country Planning (Use Classes) Order 1987 (as amended), and shall not be occupied by more than 7 persons at any time.
Reason:-
In order to ensure that the use of the building and level of occupancy does not give rise to an unacceptable level of impact on adjoining residential occupiers or have an adverse impact on the character and appearance of the area in accordance with Policy 8 of the Havering Local Plan 2016.2031. |
| 2. | Notwithstanding the detail shown on the approved plans the door connecting the historic garage (shown as Room 02 on layout plans) to the main dwelling shall be installed and maintained permanently and no cooking facilities shall be installed within this room. It shall not be occupied independently of the main dwelling and must always maintain a relationship with the main dwelling.
Reason:-
To ensure that the room is not self-contained or operated as a separate unit of accommodation, in the interests of the amenity of future occupants and to ensure compliance with the objectives of the Havering Local Plan 2016-2031. |
| 3. | Aside from those details set out in Condition 2 of this decision notice, the development hereby permitted shall not be carried out otherwise than in complete accordance with the approved plans (as set out on page one of this decision notice).

For the avoidance of doubt and to ensure that the development is carried out as approved. |
| 4. | Within three months of the date of this decision notice details details of the refuse and recycling facilities must be provided to the Local Planning Authority for approval. The refuse and recycling facilities as approved shall be implemented in accordance with approved details and retained permanently thereafter.
Reason:-
Insufficient information has been supplied with the application to judge how refuse and recycling will be managed on site. Submission of this detail prior to occupation in the case of new building works or prior to the use commencing in the case of changes of use will protect the amenity of occupiers of the development and also the locality generally and ensure that the development accords with the Development Control Policies Development Plan Document Policy DC61. |
| 5. | Within three months of the date of this decision notice details of secure cycle storage must be submitted to the Local Planning Authority for approval. The cycle storage facilities as approved shall be implemented in accordance with approved details and retained permanently thereafter.
Reason:-
Insufficient information has been supplied with the application to demonstrate what facilities will be available for cycle parking. Submission of this detail prior to occupation in the case of new building works or prior to the use commencing in the case of changes of use is in the interests of providing a wide range of facilities for non-motor car residents and sustainability. |
| 6. | Statement Required by Article 35(2) of the Town and Country Planning (Development Management) Order 2015: No significant problems were identified during the consideration of the application, and therefore it has been determined in accordance with paragraph 38 of the National Planning Policy Framework. |
| 7. | The applicant should note that this planning permission relates to the use of the building as a (sui generis) house of multiple occupation (HMO), providing communal living accommodation for seven persons. Any self containment of the rooms to create separate residential units or studio flats would require planning permission in its own right. |
