1.The Council consider that the proposed development would unacceptably harm the amenity of neighbouring property, specifically No.36 Queens Gardens by reason of loss of outlook, loss of light and overbearing effect on this property.
2.The information provided by the developer fails to comply with the guidelines for Larger Homes Extensions as outlined in Schedule 2, Part 1, Class A of the Town and Country Planning (General Permitted Development) (England) Order 2015 specifically the height of the eaves of the part of the dwellinghouse enlarged, improved or altered would exceed the height of the eaves of the existing dwellinghouse and would exceed the limits in paragraph A.1(d).
3.This written notice indicates that the proposed development would not comply with condition A.4 of Schedule 2 Part 1 Class A of the Town and Country Planning (General Permitted Development) Order 2015. It is important to note that this written notice does not indicate whether or not the proposed development would comply with any of the other limitations of conditions of Schedule 2 Part 1 Class A. The applicant has the right to an appeal against this notice to the Planning Inspectorate, see details below.
