1.Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) (England) Order 2015, no window or other opening (other than those shown on the submitted and approved plan,) shall be formed in the flank wall(s) of the building(s) hereby permitted, unless specific permission under the provisions of the Town and Country Planning Act 1990 has first been sought and obtained in writing from the Local Planning Authority. Reason:- In order to ensure a satisfactory development that will not result in any loss of privacy or damage to the environment of neighbouring properties which exist or may be proposed in the future.
2.The roof area of the extension hereby permitted shall not be used as a balcony, roof garden or similar amenity area without the grant of further specific permission from the Local Planning Authority. Reason:- In the interests of the amenity of the occupiers of neighbouring dwelling.
3.Prior Approval Informative The applicant should note that this consent is solely for the details outlined on the application form for a single storey rear extension with an overall depth of 4.5m, a maximum height of 2.7m, and an eaves height of 2.7m. (PRIOR APPROVAL). The eaves height needs to be in accordance with MHCLG Permitted development rights for householders Technical Guidance dated September 2019. The drawings provided with this application does not conform in the way that the eaves height should be measured, and therefore a further Larger Homes Extension Application for a single storey rear extension may be required or a householder planning application. The applicant is advised in line with general protocol that if the measurements on this application are to be retained that a Certificate of Lawfulness application is submitted to ensure that permitted development guidelines have been correctly interpreted. From the plans provided, it is seems that the eaves and overall height are incorrect, as the height on the cross section states 3m and the overall height should include the roof light. The variation is ground levels within the site need to be clearly demonstrated so any further applications can be assessed. Planning permission is required for the raised patio/decked area as it is more than 30cm in height. Non compliant with the measurements on the application form may result in enforcement action.
