1.The Council consider that the impact of the proposed development, by reason of its depth and proximity to the boundary of the site, would unacceptably harm the amenity of the adjacent neighbours at No.90 Grosvenor Drive, Hornchurch by reason of loss of light, outlook and overbearing effect on this property.
2.The cumulative width of the proposal would have a width greater than half the width of the original dwelling house as the proposal would connect to an existing two storey side extension and therefore would not comply with permitted development as outlined under Schedule 2, Part 1, Class A of The Town and Country Planning (General Permitted Development) (England) Order 2015 and the MHCLG Permitted development rights for householders Technical Guidance (September 2019).
3.This written notice indicates that the proposed development would not comply with condition A.4 of Schedule 2 Part 1 Class A of the Town and Country Planning (General Permitted Development) Order 2015. It is important to note that this written notice does not indicate whether or not the proposed development would comply with any of the other limitations of conditions of Schedule 2 Part 1 Class A. The applicant has the right to an appeal against this notice to the Planning Inspectorate, see details below.
4.Certificate of Lawfulness Informative The applicant should note that the overall height should include any roof lights on top of the proposal as the overall height is to the top of flat roof.
