1.The proposed development fails to meet Schedule 2, Part 1, Class A.1 (d) of the Town and Country Planning (General Permitted Development) (England) Order 2015, (as amended) as the proposed eaves height at 3 metres would be above the height of the existing eaves. Furthermore, the Council consider that the proposed development by reason of its excessive depth, bulk, scale and mass as well as the position close to the boundary of the site would unacceptably harm the amenity of the neighbouring residents at No. 5 Barton Road, Hornchurch by reason of loss of light, outlook and overbearing effect on this property.
2.This written notice indicates that the proposed development would not comply with conditions A.1(d) and A.4 of Schedule 2 Part 1 Class A of the Town and Country Planning (General Permitted Development) Order 2015 (as amended). It is important to note that this written notice does not indicate whether or not the proposed development would comply with any of the other limitations of conditions of Schedule 2 Part 1 Class A. The applicant has the right to an appeal against this notice to the Planning Inspectorate, see details below.
